The best bio and health-care company in South Korea, C company, in order to manufacture biosimilar, filed a patent invalidation trial against a multinational company, Z company, that owned an original patent. AIP represented C company in the trial for invalidating the first patent in Z company’s patent net. AIP discovered that Z company’s patent limited the patients to be applied and had a use invention characteristic that limited method·capacity and made arguments that applied legal principles on description requirement of use invention, which resulted in the complete invalidation of Z company’s core patent. With the arguments, C company could invalidate Z company’s major patents and overcome patent-related obstacles in manufacturing the biosimilar.
