A case related to the patent for a driving motor for a drum washing machine
AIP, representing L company that holds a patent for a driving motor for a drum washing machine, filed a trial for patent infringement and damages against D company. Subsequently, D company filed a trial for invalidating L company’s patent; however, AIP effectively defended against the invalidation trial through a correction trial and, accordingly, won the trial for patent infringement and damages. This case is meaningful in that AIP has elicited the Supreme Court’s unanimous ruling that the validity of a patent can also be in a trial for patent infringement or damages.
