A case related to the patent for the manufacture of raw materials of the polyester having high trans
A leading chemical company in South Korea, S company, filed an invalidation trial against a foreign company, R company, which held patents for anhydrosugar alcohols, raw materials of the polyester having high transparency, to prevent patent infringement issues from being raised in advance. Limitations put on the substance called anhydrosugar alcohols via manufacturing methods, purity, or parameter featured the patents. AIP developed logics based on legal principles for judging patentability of a product by process claims, a product invention that limits purity, and parameter limitation invention to invalidate the patents. As a result, AIP successfully invalidated the patents and removed risks related to a potential patent infringement litigation.
