Patent Case for Ground Excavation Equipment

Ground excavation equipment is an equipment that excavates a hole in the ground and rock and then fills the hole with mortar (concrete) to form a pile. Company C, a specialized construction company in Korea, filed a request for preliminary injunction on construction against Company S, a leading construction company in Korea, because the ground excavation equipment used at the construction site of Company S infringed on Company C's patent. AIP, on behalf of Company S, drew out a decision to dismiss the request for preliminary injunction by insisting that the ground excavation equipment used by Company S at the construction site was made only of known technology and did not infringe the patent of Company C, and thus prevented the delay in S company’s construction due to the preliminary injunction.
