A case related to the patent for a double lid for a container
A double lid for a container is a lid that makes it possible to take beverage and solid adjuvant together. C company, a right-holder of the patent, filed a positive confirmation trial for the scope of a right, in which C company challenged the invention of the double lid in the picture above and argued that the invention is within the scope of rights of C company’s patent, against J company, and it was decided that the accused invention was within the scope of rights of C company’s patent. However, at the Patent Court of Korea, AIP became a new representative of J company and won the case, after a thorough examination, by arguing that the accused invention is not within the scope of rights of C company’s patent due to the difference in elements between the accused invention and the patent.
