A case related to the patent for device of collecting bio-data of cattle (Invalidation case)

U company requested an injunction against the Rural Development Administration (“RDA”), D company, and H company, alleging patent infringement over a capsule-type device, which diagnoses disease of cattle by collecting their bio-data. AIP, representing H company, filed a patent invalidation trial, and subsequently, Kim & Chang, representing U company, asserted the validity of the patent. The Intellectual Property Trial and Appeal Board (“IPTAB”) ruled the patent invalid. U company thereafter filed an action with the Patent Court to revoke the IPTAB decision on invalidity. However, the Patent Court also ruled the patent invalid. Consequently, H company, which participated in a project led by RDA to disseminate a diagnostic system for livestock disease across the country, can now implement the project smoothly.
