AIP represented at the appeal for the patent
invalidation case (Supreme Court 2018Hu11360) on behalf of a right-holder of
the patent for the skin lifting procedure kit of Y. Jacobs Medical company,
which was widely known during the Choi Soon-sil scandal, and drew out the
Supreme Court’s decision to dismiss the appeal upholding the patent court’s
ruling that recognized the validity of the patent in April 9, 2020. This is the
first case as in legal principal to be decided en banc by reviewing the
precedent, which teaches that one cannot assert a new cause for invalidation in
the patent court’s trial for canceling the decision when the request for trial
was dismissed due to the principal of double jeopardy. This ruling is also
regarded as a historic ruling recognizing that in a double jeopardy case, the
patent court’s scope of hearing can be limited.
