Patent Case for Functional Food That Enhances Cognitive Function

Bio venture company B identified a specific peptide structure by hydrolyzing silk fibroin protein and discovered that it has a function of enhancing cognitive function. B’s thesis on the specific peptide structure was published in the journal and the patent application was registered. However, the thesis itself was withdrawn as a defect was revealed in some portion of the thesis by a report from a competitor company P, and P moved to invalidate the patent. AIP, which represented the invalidation trial protected the patent from being invalidated by drawing a legal argument that the defect in B’s thesis does not fall under the ground for patent invalidation as prescribed in the Patent Law.
